In this Ordinance, unless the context otherwise requires-

PART II ADMINISTRATION

The Director shall in writing appoint one or more public
officers to

The Registrar shall have such powers, functions and duties

Without prejudice to subsection (2), the Director shall have and

PART III THE REGISTER
egister of ships
The Registrar shall keep a register of ships
registered or
isionally registered under this Ordinance.
The register shall contain such particulars in respect of
ships,
rs and their respective interests in ships, demise
charterers,
gagees and representative persons as are prescribed.
The register may be kept in legible or non-legible form but if
kept in
legible form any entry in the register shall be capable of
being
oduced in legible form.

Upon receipt of an application under subsection (1) the Director

Notice of an application to the High Court under this

The High Court may, in proceedings under this section-

The Registrar shall-

subsection (2)

For the purposes of this section-
there is a material error in the register if there is an error
of fact

without limiting the generality of paragraph (a), there is a

an entry is omitted from the register;
an entry is made in the register without sufficient cause;
) an entry wrongly exists in the register; or
there is an error or defect in an entry in the register; and
the reference in paragraph (b) (i) to an entry omitted
from the
ster shall be read as including a reference to a matter
that is
ired or permitted by this Ordinance to be entered, or to remain,
in
register but is not entered in, or is removed from, the register.
The jurisdiction of the High Court under this section may be
exercised

Correction of clerical errors in register
Registrar may correct, or cause to be corrected, any clerical
error or

PART IV REGISTRATION OF SHIPS

Registrable ships
Subject to this Ordinance, a ship is registrable if-
a majority interest in the ship is owned by one or more
qualified

the ship is operated under a demise charter by a body corporate

根据2003年国家质量监督检验检疫总局公告第115号的规定,我局制定了《进口废物原料境外供货企业注册实施细则》,现予公布。

进口废物原料境外供货企业注册实施细则
第一章 总则
第一条 为切实加强进口废物原料境外供货企业的注册管理,规范对申请注册境外供货企业的注册管理工作,依据中华人民共和国国家质量监督检验检疫总局(以下简称国家质检总局)2003年第115号公告及我国对进口废物原料环境保护控制标准等国家技术规范的强制性要求,制定本细则。
第二条 本细则适用于对申请进口废物原料(废船舶除外)境外供货企业(以下简称境外企业,指合同的卖方)的注册管理工作。
第三条 国家质检总局统一管理境外企业的注册管理工作。
第四条 凡向中国出口废物原料的境外企业,必须向国家质检总局申请注册。
未获得注册的境外企业的废物原料,不允许进口,口岸检验检疫机构不受理其报检。
第二章 注册条件与申请
第五条 申请注册的境外企业必须具备以下条件:
一、是所在国家(地区)合法的经营企业;
二、有固定的办公或加工场所,具有一定的经营规模;
三、熟悉、掌握中国环境保护技术法规和相关环境保护控制标准,并具备相应的基础设施和检验能力;
四、应建立质量保证或环境质量管理体系(获ISO14000证书)或提供相应的认证资格证书,或相应制度且形成文件并已实施;
五、具有相对稳定的供货来源,并对供货来源有环保质量控制措施;
六、近3年内未发现过重大的安全、卫生、环保质量问题。
第六条 境外企业向国家质检总局提出注册申请,除提交国家质检总局2003[115]号公告所要求的材料外还应提供以下书面材料:
一、组织机构、部门和岗位职责
二、遵守中国环境保护技术法规、相关环保控制标准和中国相关法规承诺书
三、固定办公及加工场所的资料(平面图)
四、供货种类、数量及环保质量的相关证明
五、质量控制管理制度及相关技术人员(包括危险废物、夹带废物控制和废弃物处置)
六、原料验收制度
七、计量、设备校准制度
八、不合格品控制的规定
九、员工培训计划
十、对货物环保质量控制的承诺(对供货来源及供货方环保质量控制的承诺)
十一、对货物环保不合格处置所需承担相关费用的承诺
提交国家质检总局有关申请注册的文字材料,须用中文或中英文对照文本。
第七条 有下列情况之一的不予受理注册申请:
一、提供的材料不符合第五条和第六条规定要求的;
二、提供的材料不实或弄虚作假的;
三、近三年向中国出口废物原料不符合环境保护控制标准要求经查实属供货企业责任的;
四、出口废物原料弄虚作假夹带危险或禁止进口货物或有欺诈行为经查实属供货企业责任的;
五、因环保检验不合格需退运,不积极退运造成严重影响的;
六、对不合格货物进行弃货处理造成严重影响的;
七、对已退运的不合格货物变换口岸再次进口的;
八、伪造装运前检验证书的;
九、出口规模较小无法保证到货质量的;
十、其他不符合本实施细则规定要求的。
第三章 注册评审与批准
第八条 国家质检总局收到注册申请书面材料之日起30日内,作出是否受理的决定:
(一)经审查符合要求的,签发《进口废物原料境外供货企业注册申请受理通知书》;
(二)经审查不符合要求的,应当通知申请人在30日内补正,逾期未补正的,视为撤消申请;
(三)经审查不符合国家质检总局115号公告和评审规定的,不予受理申请并通知申请人。
第九条 国家质检总局在签发《进口废物原料境外供货企业注册申请受理通知书》后,组织评审人员对申请的境外企业进行考核。考核分文件审核和现场考核两部分进行,以验证境外企业申请资料的完整性、真实性,查证其内部管理及质量控制措施的有效性,测量和评估其保证输出产品符合中国环境保护控制标准要求的能力。
第十条 现场考核的组织与实施。
一、组成评审组:
评审组由数人组成,成员为从事进口废物原料检验管理及环境保护控制的专家,其资格由国家质检总局认定,评审组长由国家质检总局指定。
二、文件审核:
1.评审组成员按照本细则第六条的规定,对境外企业申请提交的材料进行审核,并按《进口废物原料境外供货企业注册评审记录》(附件一)的要求,在“文件审核”栏中逐项评审,作出判定。
2.文件审核完毕后,评审组要作出文件评审结论,对符合要求的,提出同意的意见。对不符合要求的,要通知企业在30日内纠正。
3.文件审核中发现的不符合项在限期内纠正的,评审组通过跟踪审核后,提出同意的意见。文件审核中发现的不符合项在限期未能纠正的,视为境外企业自动撤回申请。
三、现场考核:
1.评审组要根据企业特点和其输出废物原料的种类,制定现场考核计划,并将现场考核计划书面通知被考核境外企业;
2.现场考核的实施
(1)由评审组长召开会议向被考核方的管理者介绍考核的范围、目的、依据及考核的计划、方法和程序,以及评审组所需的资源和设施,评审组和被考核方之间的联系,保密承诺等事项。
(2)现场查证。评审组根据考核计划,按抽样的方法到约定的部门和生产、加工现场进行现场查证,收集客观的评审证据。评审组在查证过程中,要按照《进口废物原料境外供货企业注册评审记录》的要求,逐项核查“现场评审记录”栏中的要求事项并做好记录,作出判定,对现场查证过程中发现有不符合项的,要形成不符合项报告。
(3)评审组会议。评审组根据考核进程的需要,召开内部会议研究讨论:①评审的进度;②对审核发现(及其证据)形成一致意见,讨论考核人员提交的不符合项报告;③评价被考核方的内部管理及质量控制的情况;④考核中需要解决的其他问题;⑤形成考核意见。
考核过程中,评审组长应加强与被考核方管理者的沟通和交流,出具的不符合项报告要由被考核方代表签字确认。此外,双方要商定不符合项的纠正和跟踪验证的时间、方式等。
(4)评审组长主持召开总结会,向被考核方管理者及相关人员介绍考核发现,宣布考核意见和跟踪验证的时间、方式。
3.评审组长应当在现场考核结束后,组织编写考核评审报告并提交国家质检总局。
第十一条 国家质检总局对评审组提交的评审报告进行审核,经审核符合规定条件的,由国家质检总局予以注册,并颁发《进口废物原料境外供货企业注册证书》,授予编号。
经审核不合格的,签发《不合格通知书》(附件2),自《不合格通知书》发出之日起6个月后方可再次提出申请。

第四章 后续管理
第十二条 注册证书有效期为3年,期满要求续延的,申请人应在有效期满前3个月向国家质检总局提出续延申请。
境外企业的注册项目(法人、地址)发生变更时,应在3个月内向国家质检总局办理变更手续。
第十三条 已获注册的境外企业发生下列情况之一的,国家质检总局可对其作出暂停受理报检,直至取消注册资格的决定。被国家质检总局取消资格的企业,3年内不受理其申请。
(一)违反中国进口废物原料相关法律法规和有关规定的;
(二)违反本细则第七条有关规定
(三)口岸检验检疫机构检验中发现一次安全、卫生、环保不合格,并造成严重后果,经查确属境外企业责任的;
(四)涂改、伪造有关单证及其他弄虚作假欺诈行为的;
(五)企业注册项目发生重大变更后,未按时向国家质检总局报告的;
(六)将注册证书或编号转让其他企业使用的;
(七)违反其他规定的。
第十四条 国家质检总局或其授权的机构负责境外企业获证后的日常监督管理工作,授权的机构应将监督管理的情况报送国家质检总局。
日常监督管理的内容有:
一、对注册企业出口货物进行定期或不定期的抽查;
二、检查注册企业有无违反本办法规定的情况;
三、将口岸检验检疫机构对货物的检验情况及时反馈给注册企业;
四、对经查实注册企业违反第十三条规定的情况,及时向国家质检总局提出暂停或取消注册资格的建议;
五、监督注册企业退运不合格货物。
第五章 附则
第十五条 中国香港、澳门、台湾地区的进口废物原料供货企业的注册管理可参照本细则执行。
第十六条 本细则由国家质检总局负责解释。
第十七条 本细则自公布之日起实施。
